GENERAL TRADE CONDITIONS OF JOTKEL COMPANY

I. TRADE OFFER

1. All prices included in the offer are net prices and do not include VAT.

2. Contracting Authority’s trade conditions that are different from above mentioned must be accepted by JOTKEL Company

3. Assortment offer is valid until the next one is issued.

4. JOTKEL Company reserves the right to implement changes in products during binding time of specific offer’s version.

II. ORDERS’ REALIZATION  

1. Orders may be placed in writing, by fax, mail or Internet network.

2. Order must include the following information: product’s type (catalogue no., colour), quantity, expected realization time,

delivery address, name of Contracting Authority, NIP number, REGON number, record files number, name of contact person, telephone number

3. Orders are confirmed by JOTKEL Company

4. Standard realization time is 14 days. The date is always agreed when realizing non-standard or larger orders.

5. In case of products marked with * at catalogue number in price list and Internet network, realization time is agreed individually.

III. DELIVERY CONDITIONS 

1. In case of orders exceeding amount of 2 000 PLN (net price), delivery in Poland is free of charge.

2. Goods are delivered at delivery address given by the Customer.

3. Goods’ unloading from vehicle and other actions connected with this (bringing them into the office, warehouse, removing,

packages, assembly, etc.) are Customer’s duty, unless individual agreements determine it differently.

IV. WARRANTY

1. Goods are covered with 24-months warranty starting from sale date (warranty card together with proof of purchase is

necessary).

2. Complaints should be submitted in writing.

3. Warranty is void if the product is used against the purpose or manual’s provisions or if it is fixed or altered individually or

damaged because of user’s fault. Warranty does not include wear arising when the product is used.

4. Customer is obliged to check the product when it is delivered. If the goods are damaged during transport, Customer

should indicate it clearly on the bills of lading (consignment note, WZ proof) at the carrier’s presence and report this fact to Seller during 3 days.

V. PAYMENT CONDITIONS  

1. JOTKEL Company reserves the right to collect advance, pre-payment or earnest to the amount agreed before with

Contracting Authority.

2. JOTKEL Company would collect interest from the date of invoice payment, unless individual agreements determine it differently.

3. Payment Date is the date of receiving due amount for goods together with VAT on the JOTKEL Company account.

VI. OTHER CONDITIONS  

1. In cases that are not regulated by the above trade conditions, respective provisions of Civil Code are binding.
